What is Section 321 Type 86 clearance?

Type 86 is a U.S. Customs and Border Protection (CBP) entry type that streamlines the import process for goods valued at under US$800 (de minimis). This entry type, previously referred to as Section 321 customs clearance, exempts such shipments from duties and taxes, offering a simplified clearance procedure.

These shipments are filed on the ACE manifest without a formal Customs entry, given no entry restrictions exist. Since duty and tax exemption applies to Type 86 shipments, it also eliminates the need for an entry bond.

While Entry Type 86 is designated for PGA Regulated Goods, it can only be utilized if no fees are associated with the PGA. If fees apply, Entry Type 86 cannot be employed. Additionally, goods subject to anti-dumping and/or countervailing duties, quota restrictions, as well as alcohol and tobacco products, are ineligible for Entry Type 86 clearance.

Why did the U.S. CBP create Entry Type 86?

U.S. CBP introduced Entry Type 86 to improve the monitoring of low-value shipments entering the United States under the de minimis threshold (Section 321). This entry type enhances CBP’s ability to screen imports more effectively, helping to ensure border security, prevent the entry of prohibited goods, and maintain compliance with U.S. import regulations

Is it mandatory to file Entry Type 86?

Filing for Entry Type 86 is optional but highly advantageous for E-commerce businesses importing goods valued under US$800. Any shipment(s) that falls under the Section 321 exemption qualifies. Under this U.S. customs rule, goods valued at US$800 or less (the current de minimis threshold) can enter the U.S. duty-free and tax-free, as long as they meet all eligibility criteria. You will need to provide information on your business, originator code (for AMS) and filer code (for declaration). We will be able to assist you thereafter. 

The following shipment information must be provided for both the origin and destination: Master Bill of Lading or Master Airway Bill, House Bill of Lading, Shipper, Consolidator, Buyer, Consignee (CNEE) and HS Code. As your shipment will be delivered into the U.S. you will also require a Harmonised Tariff Schedule (HTS) shipping code.
