CBP has not clarified what an inaccurate filing would be, but indicates many ISFs are incomplete. Some of the required data elements are missing, most common includes missing bond information and/or no match in AMS on the Bill of Lading.
CBP does expect ISFs to be complete at the time of transmitting the ISF and continually updated for accuracy prior to arrival of the cargo in the U.S. since CBP wants the data for security purposes. CBP indicates anything less than 100% compliance could be exposed to liquidated damages, however we imagine the initial focus will be on non-files, late filers, and repeat offenders. The trade is encouraged to provide complete, timely and accurate ISFs to avoid claims for repeat violations.
