FAQ 22 – Do I Need a Lacey Act Declaration?

If your product has plant material and is classified under an HTS code listed on APHIS’ Implementation Schedule, and your shipment is a formal entry and falls under specific entry type codes, then you need to make a declaration. However, if your product doesn’t have any plant material, or it falls under exempt product categories, or it’s hand-carried in personal baggage, or arrives via international mail, or is an informal entry, or contains finished products not classified under the HTSUS code on APHIS’ implementation schedule, or won’t remain in the United States, or meets the de minimis requirement, then you don’t need to make a declaration.
