U.S. Customs and Border Protection (CBP) continues to roll out various programs to address several issues caused by the ecommerce boom. Entry Type 86
Entry type 86 essentially expands the coverage of Section 321 informal entries to include controlled goods or goods regulated by partner Government Agencies (PGAs) like the Food and Drug Administration (FDA). This means that both PGA and non-PGA regulated parcels can enter the country free of tax and duty and without additional requirements, as long as customs brokers provide the HTSUS
(Harmonized Tariff Schedule of the United States) code for each product in the shipment.
For CBP, Entry Type 86 is designed to improve targeting and risk assessment while keeping the flow of legitimate parcels uninterrupted. CBP can better identify high-risk parcels while speeding up the movement of low-risk shipments. For trade participants knowledgeable in HS code classification, Type 86 provides a faster and more affordable way to clear PGA and non-PGA goods.
Entry Type 86 is considered “customs business” because of HTS code requirement. At this time, only customs brokers or authorized agents are allowed to file Type 86 documentation to CBP via ABI in ACE. Section 321 clearance is still an option for filers who choose not to clear parcels via entry Type 86.
For Type 86 parcels transported by air, clearance is usually done via ECCF (Express Consignment Carrier Facility) or CFS (Container Freight Station) at major airports combined with last mile delivery via the postal system. Hybrid CFS/ECCF options are also available. The best clearance options depend on the type of shipment, with time-sensitive non-postal parcels ideally cleared through ECCFs.
